Description

Florian Mauchle, who has helped the management by taking the duty of the certificate authority due to our lack of a registrar, has stopped responding to the managements requests. We need to decide if there is any way we can solve this by contacting him or if we need to go to the court with him. :(

Here are the two mails in question that I had sent him. Especially the second one is a legal problem, as we as the board have failed to meet the time limit given to us by the bylaws.

Hallo Flo

Sorry, dass Du so lange nach der letzten PV auf diese Mail warten musstest. Die GL besteht nun noch aus Oli und mir und wir wollten bei Dir nachfragen, wie es bei Dir, auch zeitlich, bezüglich der Urabstimmungs-Arbeit aussieht.

Mein letzter Stand ist, dass sowohl im Vorstand wie auch in der GPK derzeit Personen mit Authoritäts-Zertifikat fehlen. Mit Oli habe ich die Zertifizierung letzten Sonntag durchexerziert und ich hoffe Du erhältst seine Zertifikatsanfrage in den nächsten Tagen. Gerne kann ich versuchen der GPK meine Hilfe dazu anzubieten, falls das noch nötig wäre.

Ansonsten ist für Oli und mich natürlich noch die grosse Frage, wie es mit der Zertifizierungsstelle weiter gehen soll. Sicher hast auch Du nicht Zeit im Überfluss und bei Oli und mir sieht es natürlich ähnlich aus. Nichts desto trotz liegt diese Funktion in unserer Verantwortung: Wenn Du dieses Amt lieber abgeben möchtest, gib mir bitte Bescheid, damit wir einen Termin abmachen können, an dem Du mich in die Arbeit einführen und mir das Amt übergeben kannst.

Könntest Du mir weiterhelfen? Wie müssen wir vorgehen um eine Abstimmung einzuleiten. Müssten das Oli oder ich einleiten oder müsstest Du das machen? Und falls letzteres, kann ich Dich dabei irgendwie unterstützen?

What a birthday present, a revenge suit :-)
I can inform the board that
a) the last action on the CA that was done was the creation of a new server certificate by request of Stefan Thöni to replace the expired one (evidence to be produced if contradicted)
b) the synchronization of the certificate to the current state of the member database leads to the deactivation/expiration of all the voter's certificates and was therefore omitted since there are no current updates on the state of payment in the mdb entered by the treasurer. (evidence of my voting rights attached. Payment of membership fee wasn't entered, therefore voting rights expired by 2014-02-15)
c) there is currently no possible way to start a pivote voting because the number of authorities who have the required certificate is below the number needed according to the bylaws and the Urabstimmungsordnung (names of people will be revealed if contested)
d) I informed Guillaume Sauli as a representative of the ANK thusly on the 14th of february in a lengthy viber talk from Iceland. He told me he will inform the ANK and the president of the Pirateparty of this situation and abstain from enforcing the Urabstimmung for the reasons explained in preceding and subsequent paragraphs (evidence through witnesses)
e) an Urabstimmung to be executed over the ending of one voter's rights period and the beginning of another leads to an unpredictable composition of the voting body since a lot of pirates would be deprived of their voting rights due to lack of payment or registration thereof. An Urabstimmung decision taken this way would thus always challengeable in court due to the violation of constitutional rights, i.e. freedom of association and arbitraryness. (evidence through doctrine and jurisdiction provided if needed, but I'll have to play Hermione Granger first - and go to the library)
