Suspension of a forum account¶
After receiving additional information from Stefan, the CC concluded unanimously to give recommendations to the board as mendioned below.
The CC also concluded unanimously to make this recommendation public after removing the name of the forum account in question.
The minutes of the meeting have been read and accepted byDear Board,
On October 15 2013 the Board formally requested that the Control Committee investigate the circumstances of the suspension of the forum account "X.______________".
It is not within the mandate of the CC to investigate attacks on the party's IT systems. Therefore the CC will not enter into the substance of the matter.
Despite this, it is the opinion of the CC that criminal liability for the unauthorized suspension, namely under the provisions of "Unauthorised access to a data processing system" or "Damage to data" is questionable and at most a minor offence. As such, it would probably not be investigated by police even if reported. Otherwise this might end up unpleasant and possibly disruptive to both party activities and the lives of people involved.
The CC recommends to the Board not to file criminal complaint.
The Board should however take measures to avoid a repetition of this incident. To achieve this, security as a whole should be reevaluated and the appropriate measures taken. Especially the handling of access and passwords appears to need some attention. A dedicated position to deal with security issues would seem appropriate.
The CC recommends to the Board to appoint a new Security and Privacy Officer at the earliest opportunity.
